La Ley de Urgente Consideración (LUC) y la urgencia de la ciudadanía

Abstract

El presente trabajo discute sobre una temática que involucra directamente a las nociones de ciudadanía y democracia. Analiza las condiciones de sanción y las críticas orquestadas desde el movimiento social y sindical, la academia y partidos opositores, a la primera y principal propuesta legislativa de la coalición de gobierno: Ley de Urgente Consideración (LUC). Asimismo, analiza la iniciativa de referéndum impulsada por organizaciones nucleadas en la Intersocial y el PIT-CNT, con el apoyo político-estratégico del Frente Amplio (FA). Problematiza las implicancias de la ley a nivel político y social, así como la significación de apelar a un mecanismo de democracia directa en el contexto actual de emergencia sanitaria. Por último, discute sobre los desafíos que implica la derogación de la normativa y los significados del proceso para la sociedad civil organizada, depositaria de una rica herencia de movilización y lucha por la disputa política y defensa de los intereses “comunes”.

This paper discusses issues related to the notions of citizenship and democracy, generated around the first and most important bill of the current government coalition, the “Urgent Consideration Law”. It reviews the conditions in which the bill was passed, and the critiques raised from the social and workers movement, the academy and opposition parties. It analyzes the referendum proposal, backed from social organizations gathered in the “Intersocial”, the “PIT-CNT” and the political and strategic support by the “Frente Amplio”. The paper also problematizes the bill’s implications in both the social and the political spectrum, and the significance of appealing to a mechanism of direct democracy under the pandemic context. Lastly, it discusses the challenges implied in derogating the bill, and the significance of the process for the organized social movement of Uruguay, who carry a vast history of collective organization, political disputes, and defense of the “common” interests.
