El diagnóstico con fines clasificatorios en el sistema penitenciario uruguayo

Abstract

La presente investigación estudia las prácticas diagnósticas con fin clasificatorio, que se implementan en el sistema penitenciario uruguayo, con respecto a la población masculina adulta, procesada con prisión en la zona metropolitana, en tanto pieza de conocimiento e interpretación experta. El dispositivo de clasificación fue creado con la finalidad de brindar asesoramiento técnico, basado en la individualización del riesgo criminal o peligrosidad, a los efectos de gestionar y ordenar el flujo de ingresos al sistema penitenciario así como de administrar la privación de libertad, mediante la organización de diferentes grados de incapacitación y niveles de seguridad. Identificamos y discutimos críticamente las dimensiones más regulares que sustentan la clasificación de personas en el sistema penitenciario uruguayo y que definen los rasgos esenciales del “sujeto peligroso”; consustanciales al discurso hegemónico producido por el dispositivo. Esta definición encuentra su correlato en las representaciones sociales más generales acerca del fenómeno delictual. Reflexionamos en torno de los alcances y limitaciones del diagnóstico con fin clasificatorio, en el afán de contribuir a la revisión del castigo legítimo, que se hiper-concentra en los sectores sociales más vulnerables, y en el marco del desafío que le supone a nuestra sociedad afrontar las dificultades que impiden incluir y brindar seguridad a todos sus integrantes.

The present investigation studies the diagnostic practices with the classificatory aims, that is implemented in the uruguayan penitentiary system, with respect to the adult male population, processed with the prison in the metropolitan area, as an object of knowledge and expert interpretation. The classification device was created with the purpose of providing technical advice, based on the individualization of the criminal risk or danger, with the aim of managing and ordering the flow of income to the penitentiary system as well as managing the deprivation of liberty, through the organization of different degrees of incapacitation and levels of security. We identify and critically discuss the more regular dimensions that support the classification of people in the uruguayan prison system and that define the essential features of the "dangerous subject". This definition finds its correlate in the most general social representations about the criminal phenomenon. We ponder on the range and limitations of the diagnosis in order to classify, in the effort to contribute to the revision of legitimate punishment, which is hyper-concentrated in the most vulnerable social sectors, and in the framework of the challenge that our society poses face the difficulties that prevent inclusion and provide security to all its members.
