Sujetos y narrativas de poder : la construcción legal del inmigrante en el siglo XIX argentino

Abstract

Este artículo examina la construcción político-jurídica del sujeto inmigrante en la Argentina del siglo XIX, a partir de la articulación entre ficciones literarias y textos legales. Se sostiene que el inmigrante es un efecto de coproducción simbólica entre los dispositivos jurídico-administrativos (leyes de 1879 y 1902) y las narrativas de la ciudad letrada (ensayo, prensa y poesía gauchesca). Mediante el análisis de Facundo y Martín Fierro, junto con la Ley de Inmigración y Colonización (1879) y la Ley de Residencia (1902), se muestra cómo las tensiones discursivas entre civilización y barbarie produjeron tecnologías de clasificación, sospecha y excepción que instituyeron al inmigrante como figura ambivalente : esperanza de progreso y, al mismo tiempo, enemigo político. El cruce entre derecho y literatura se propone aquí no como adorno hermenéutico, sino como método crítico capaz de desvelar la gramática de exclusión que organiza la subjetividad migrante en el archivo jurídico y cultural argentino.

This article analyzes the political and legal construction of the immigrant subject in 19th- century Argentina, focusing on the interplay between literary fictions and legal texts. It argues that the immigrant emerged as a symbolic co-production between legal-administrative devices (the Immigration and Colonization Law of 1879 and the Residency Law of 1902) and the narratives of the ciudad letrada (essays, press, and gauchesque poetry). Through the reading of Sarmiento’s Facundo and Hernández’s Martín Fierro, alongside key legislative measures, the study demonstrates how discursive tensions between civilization and barbarism gave rise to technologies of classification, suspicion, and exception that shaped the immigrant as both a promise of progress and a political enemy. The encounter between law and literature is approached not as a hermeneutic ornament but as a critical method that reveals the grammar of exclusion underlying the legal and cultural archive of Argentina
