El derecho de acceso a la información pública en Uruguay

Abstract

Correa Freitas presenta un estudio sobre los alcances y los límites legales y constitucionales del acceso a la información pública en Uruguay identificando los controles entre poderes del Estado y las garantías de información de los ciudadanos. El artículo se concentra en los mecanismos de rendición de cuentas en el Legislativo, el Ejecutivo y el Judicial, así como en las funciones de la Auditoría de Cuentas del país, los partidos políticos e instituciones autónomas, en su relación con la difusión de información. El autor concluye que para la mejor garantía del derecho fundamental a la información, se requiere una reforma a la Constitución uruguaya y la adecuada sanción de legislación especializada.

In this article, Correa Freitas presents a legal study of the limits and scope of the right to access to information in Uruguay, and identifies the checks and balances between the State powers and the consitutional rights of the citizens. He focuses on the accountability mechanisms within the Legislative, the Executive and the Judicary, as well as on the role of the Controllership, the political partes and autonomous institutions in relation to the dissemination of information. The author concludes that, in order to improve the protecitonj of the right to access to information, a consitutional reform and the special legislation is needded in Uruguay
