Resumen:
El presente estudio aborda la responsabilidad por daño ambiental en Uruguay, regulada principalmente en el artículo 47 de la Constitución de la República, la Ley N° 16.466, de 19 de enero de 1994 (Ley de Evaluación de Impacto Ambiental), y la Ley N° 17.283, de 28 de noviembre de 2000 (Ley General del Ambiente). Analizaremos como Uruguay definió al daño ambiental en su Ley General del Ambiente, pero sin haber tomado en consideración su regulación en la Ley de Evaluación de Impacto Ambiental. Muchos de estos aspectos se han intentado de corregir en el Proyecto de Ley sobre Responsabilidad por Daño Ambiental, a estudio del Parlamento, y del cual el autor de este artículo ha sido corredactor.
