Con fundamento en el derecho a comprender, en las últimas décadas han surgido
movimientos que plantean la necesidad de reformular el lenguaje del Derecho para que
sea más claro para la población no especialista, lo que se conoce como lenguaje jurídico
claro. En esta investigación se estudia de qué manera se han recogido estas corrientes en
las sentencias uruguayas del siglo XXI. Para ello, la metodología empleada fue el análisis
de un corpus de sentencias seleccionadas a partir de criterios de búsqueda determinados.
En el marco teórico se presenta la lingüística jurídica como campo de estudio
interdisciplinario en la intersección entre el Derecho y el lenguaje. Además, se discute la
existencia del derecho a comprender como derecho lingüístico para garantizar el acceso
a la justicia, el lenguaje jurídico claro como su principal exponente y las ideologías
lingüísticas de la claridad, entre otros aspectos. El análisis de los datos se organizó en tres
partes. En la primera parte, se analizan sentencias que adaptan el lenguaje según el
destinatario. En la segunda parte, se evalúa si las referencias metalingüísticas y
doctrinarias sobre el lenguaje jurídico en las sentencias reflejan el espíritu del lenguaje
jurídico claro y el derecho a comprender. En la tercera parte, se clasifican los resultados
obtenidos en atención a los siguientes factores: materia, sede, proceso y destinatario de
la sentencia. La investigación permitió observar que las sentencias uruguayas recogen
propuestas vinculadas al lenguaje jurídico claro y al derecho a comprender desde un
enfoque performativo y desde un enfoque descriptivo. Asimismo, se concluye cierta
prevalencia de materias y destinatarios en las sentencias estudiadas, que en particular se
relacionan con indicios de vulnerabilidad.
Based on the right to understand, in recent decades certain movements have emerged raising the need to reframe the language of the law to make it clearer for people not trained in law. This is known as plain legal language. Throughout this research, the ways in which 21st Century Uruguayan judgments portray these movements are explored. For such purposes, the methodology implied a corpus-based analysis of judgments selected from certain search criteria. In the theoretical framework, legal linguistics as an interdisciplinary field of study at the intersection between law and language is explored. Additionally, the existence of the right to understand as a linguistic right to guarantee access to justice, plain legal language as its main exponent, and plain language ideologies, among other aspects, are discussed. Data analysis was organized in three sections. First, judgments accommodating language depending on the addressee were analyzed. Second, metalanguage and legal literature references to legal language on the judgments were weighed against the spirit of plain legal language and the right to understand. Third, results were classified according to the following factors: area of law, court, proceedings, and addressee. This research revealed that Uruguayan judgments incorporate plain legal language and right to understand proposals from a performative and from a descriptive approach. Furthermore, certain prevalence of areas of law and addressees may be noted in the reviewed judgments, particularly related to vulnerability signs.
