Resumen:
El objetivo de este artículo es analizar las producciones científicas de los últimos cinco años respecto al consentimiento sexual. Se consultaron bibliotecas virtuales, bases de datos, libros, diccionarios, documentos y legislación nacional e internacional y se seleccionaron producciones relevantes al tema. Se detectó el mayor volumen de investigación en el campo jurídico y pocas contribuciones desde la Sociología y la Psicología, identificándose los principales puntos de discusión y los temas de vacancia. En el análisis se observa la falta de consenso para la definición y usos del consentimiento sexual y cómo incide en las redefiniciones de delitos sexuales en las reformas de códigos y normativa para la prevención de la violencia sexual, especialmente en los Estados Unidos de América. Se discute la necesidad de nuevos aportes desde la Psicología y en el debate público en los países de América Latina.
In this paper, I analyze the scientific productions of the last five years addressing sexual consent. For the selection of the material I used virtual libraries, databases, books, dictionaries, documents and national and international laws and statutes. Most investigations come from the legal field and there are only a few which correspond to sociological and psychological research. I identify the main points of discussion, as well as the vacancies and shortcomings. In the analysis I observe a lack of agreement in how consent is defined, understood and communicated and its impact in drafting new definitions of sexual assault and rape in criminal laws and statutes for the prevention of sexual violence, particularly in the United States of America. I discuss the need of more research and contributions to this theme from Psychology and in the public debate in Latin American countries.
